Terms of Service

These terms are a plain-English agreement between you and StillHere. By creating an account or using the app or website, you agree to them. If anything here is unclear, email us at hello@stillhere.app and we'll explain.

1. StillHere is not an emergency or medical service

StillHere is not a substitute for emergency services. In an emergency call 911. StillHere is a check-in and notification tool. It does not contact 911, dispatchers, hospitals, or first responders, and it does not provide medical advice, diagnosis, monitoring, or care. Alerts depend on phone networks, app-store push services, and third-party SMS/voice providers, which can fail or be delayed. Never rely on StillHere as your only safety measure.

2. Who can use StillHere

You must be at least 16 years old and able to enter into this agreement. If you set up StillHere on behalf of a loved one (for example, an aging parent), you confirm that they know about it and agree to be checked on, and that the emergency contacts you add have agreed to receive alerts.

4. Subscriptions and billing

Premium and Family plans are subscriptions billed through the Apple App Store or Google Play — not by us directly. Prices are shown in the app before you subscribe. Subscriptions renew automatically until cancelled.

To cancel, use your device's store settings (App Store: Settings → your name → Subscriptions; Google Play: Play Store → Payments & subscriptions). Cancelling stops the next renewal; your plan stays active until the end of the period you've already paid for. Refunds are handled by Apple or Google under their policies.

We may suspend or close accounts that violate these rules or put other users at risk.

6. The service, availability, and changes

We work hard to keep StillHere reliable, but no service is perfect. We provide StillHere “as is” and “as available”, without warranties of any kind to the extent the law allows. We may update, change, or discontinue features; if we discontinue the service entirely, we will give you reasonable notice.

7. Limitation of liability

To the maximum extent permitted by law, StillHere and its team are not liable for indirect, incidental, special, or consequential damages, or for losses arising from missed, delayed, or failed notifications, network or carrier outages, or events outside our reasonable control — including injury, loss of life, or property damage that a notification might otherwise have helped avoid. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and CAD $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

8. Your data

Our Privacy Policy explains what we collect and why. You can export or delete your data in the app at any time.

9. Ending your relationship with us

You can stop using StillHere and delete your account at any time in the app's settings. Remember to also cancel any subscription in your store settings — deleting the app or the account does not cancel a store subscription by itself.

10. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it. Nothing in these terms limits consumer rights you have under the mandatory laws of where you live.

11. Changes to these terms

If we make meaningful changes, we'll notify you in the app before they take effect. Continuing to use StillHere after that means you accept the updated terms.
